Court rules consent of spouse needed for transsexual to change identity code gender
The Supreme Administrative Court has ruled that a married male-born transsexual cannot change his gender in the population register from male to female without the consent of the wife.
Tuesday˘s decision involves a transsexual who has been married for more than ten years. Since the marriage, he has embarked on gender reassignment treatment.
The couple have an underage child.
The personal identity codes given to Finnish residents differentiate between male and female. Gender is identified by the number that follows the birth date in the code: the even numbers are for women and the odd numbers are for men.
In the case at hand, the transgender husband wanted to change the identity code. He felt that a male identity code combined with his female appearance would reveal his status as a transsexual, and could cause difficulties during security inspections, for instance.
The matter was taken to the Supreme Administrative Court after the local register office and the Helsinki Administrative Court refused to grant a new identity code.
The Supreme Administrative Court ruled that changing the code in the population register system is not possible because the wife refuses to confirm the new gender of her husband.
The wife˘s agreement to the move would turn their marriage into a civil union between two women.
The law does not allow an actual marriage between two people of the same gender.
According to the appeal made by the man, the two do not want to dissolve their marriage, as that would go against their Christian convictions.
